This Website is owned and operated by Connecticut Community Care, Inc. (CCCI). Your use of this Website is subject to the following Terms of Use that may be revised by CCCI, at its sole discretion. Your use of the Website constitutes acceptance of these Terms of Use. You agree to discontinue use of this Website immediately upon your disagreement with or breach of any of these Terms of Use. Please also review the Website’s Privacy Policy that contains information on cookies. If applicable, for purchases made through the Website, please review the Refund Policy on the CCCI Website.

Important Notice Regarding Claims and Agreement to Arbitrate (Arbitration applies to U.S. users only). PLEASE NOTE: these Terms of Use contain certain Disclaimers and Limitations on our Liability. In addition, for users who reside in or access the Site from the U.S., these Terms of Use contain a binding Arbitration Clause and Class Action Waiver, which waives your right to sue in court or seek a jury trial for disputes relating to your use of the Site. These are found in the Disclaimer of Warranties, Exclusion of Liability and Indemnity and Dispute Resolution Sections below. We reserve the right to refuse any product purchase order you place with us or limit or cancel quantities purchased per person, per household or per order. THE FOLLOWING TERMS TO WHICH YOU ARE CONSENTING CONSIST OF A BINDING ARBITRATION PROVISION AND A CLASS-ACTION AND JURY TRIAL WAIVER.

To the fullest extent permitted by law, by using the Site, you agree that if a dispute arises between you and CCCI relating in any way to the Site or your use thereof, including common law or statutory claims, BOTH YOU AND CCCI SHALL SUBMIT TO BINDING ARBITRATION BEFORE THE AMERICAN ARBITRATION ASSOCIATION. ANY ARBITRATION COMMENCED BETWEEN YOU AND CCCI MUST BE ARBITRATED IN NEW YORK. ARBITRATION MUST BE ON AN INDIVIDUAL BASIS. THIS MEANS NEITHER YOU NOR CCCI MAY JOIN CLAIMS IN ARBITRATION WITH OR AGAINST OTHER USERS, OR LITIGATE IN COURT OR ARBITRATE ANY CLAIMS AS A REPRESENTATIVE OR MEMBER OF A CLASS. YOU UNDERSTAND THAT BY AGREEING TO ARBITRATION YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE IN COURT, THE RIGHT TO HAVE THE DISPUTE DECIDED BY A JUDGE OR JURY, AND THE RIGHT TO BRING, OR BE PART OF, A CLASS ACTION CASE. The foregoing shall not apply to suits to enjoin infringement or other misuse of intellectual property rights, and you or CCCI may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

If any portion of these terms is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law to the greatest extent possible and the remainder of the provisions shall remain in full force and effect. Any cause of action you may have with respect to this Website must be commenced within one year after the claim or cause of action arises or such claim or cause of action is barred. These Terms of Use are governed by the laws of the State of Connecticut. You agree to the exclusive jurisdiction of the United States Federal Court for the District of Connecticut or the courts of the State of Connecticut, as applicable. Access to this Website from locations outside the United States are at your own risk, and you hereby accept responsibility for compliance with the laws and regulations of any such foreign jurisdiction that may govern your use of this Website. CCCI expressly disclaims responsibility for compliance with laws and regulations outside the United States.

We may change or discontinue this Web site or any feature on it at any time with or without notice. CCCI may, in its sole discretion, terminate or suspend your access or refuse service at any time, without notice, to all or part of any of the Web site for any or no reason, including, without limitation, breach of these Terms of Use or the infringement of copyrights.

In the event that CCCI is sold to a third party, such a sale will not be deemed a transfer of personal information so long as that third party agrees to assume CCCI’s obligations as to these Terms of Use and associated Privacy Policy. A receiver placed over the company may sell, transfer or license all company assets, including customer information.

In the event that you believe your copyright has been violated by content appearing on the website, you may submit a complaint to CCCI at [email protected] with the following information:

  • Your contact information, including your name and either email address, mailing address, or telephone number;
  • A brief description of the work or works that you believe is being infringed;
  • The specific location (URL) of the allegedly infringing content on the website;
  • A statement affirming that you “have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law”;

CCCI will respond expeditiously to all such complaints substantially complying with these informational requirements. CCCI cannot guarantee a response or any action for complaints with incomplete or inaccurate information.
